In order to prevent the automatic suspension/revocation of your driver’s license following an arrest for DUI you must submit a written hearing request to the DOL and the $350 hearing fee within 20 days of the date you were stopped for DUI. This is true whether or not you were put into handcuffs, taken to jail, or simply cited and released. You will then have to prevail in your administrative hearing with the DOL in order to keep your license from being suspended or revoked. Failure to submit the hearing request and fee within 20 days will result in the automatic suspension of your license. The length of this suspension will depend on whether you blew above .08 (90 days) or refused a lawfully requested breath or blood test (1 year).
