Motions to dismiss can be successful when the charging document fails to charge a crime, there is insufficient evidence to establish probable cause for the crime charged, or there is an error in the charging document. Most minor irregularities in the charging document will not result in dismissal. However errors that prejudice the defense in the presentation of their case can result in dismissal. I will examine the charging documents, the underlying police reports, witness statements, and physical evidence.
